Stephen Milne's lawyers to decide on rape trial abandonment

Most of the story doesn't seem to relate to the headline. Maybe one of our resident lawyers could tell us what it all means.
Lawyers for former St Kilda player Stephen Milne will decide this week if they will apply to have his rape trial abandoned.
Defence barrister Ruth Shann told County Court judge Michael Bourke on Monday that a possible application to stay the proceedings against Mr Milne would be discussed with Philip Dunn, QC, the trial lawyer hired to represent the former Saints star.

as an extreme novice on most things legal- how can they be the ones to decide on abondonment?- wouldn't that be up to the offended person and her lawyers?

Maybe we could re-draft Dennis-Lane… he kicked 66 in the WAFL so would also push 100 in the BFL

Plus you don't get the benefit of a delay if you're the cause of it, as has been the case with Essendon. As for Milne, it may be a difficult submission to succeed on because historic offences are prosecuted frequently.

IMHO, a stay application premised purely on the effluxion of time involved in this matter would be doomed to failure.

Driving in to park the car this morning, nearly ran over a bloke and his family walking through the keep clear zone outside the Magistrates' Court.

My arms were waving everywhere when the bloke put up his hand to apologise, and I realised it was Milney and his wife and others.

I thought he was looking remarkably relaxed for a bloke about to stand trial, and I was wishing I had thought of something appropriate to yell out the car window.

Except that there is nothing appropriate to yell out the window in those circumstances.

So I'm very happy to arrive at my desk to see that sense has prevailed on both sides.

So he will be a convicted something?????

I personally find it a bit strange he will admit to this adjusted charge. They must have been concerned about a rape conviction if they have agreed to a lesser charge. If he believed he was innocent, I thought they would fight it all the way.

Anyway I suppose if this means no jail time it will be a relief for his family, and they can finally move on to some extent. Good luck Milney.

Problem is he cant prove he was innocent. Clearly something happened that has upset the young girl even if Milne believes he did nothing wrong its basically impossible to clear his name.
