Steve The difference is that a block can be a type of shepherd. Under Law 15.4.2: "A Shepherd is using the body or arm to push, bump or block: (a) a Player who does not have possession of the football and who is no further than 5 metres away from the football at the time when the push, bump or...

He won't be able to change his testimony now .. don't think that was the problem anyway. They simply have to focus on what is a block - and how could he have forseen Farmer crashing into him. Blocking a player's run is not reportable - causing injury in an unreasonable action is. So, was Bakes actio...

Well that sounds more like they switched on now. Those grounds are very relevant in this case. Was his action reckless?? Does just merely laying a block on a player constitute an untoward / reckless action. No, of course it doesn't - and the eventual contact was accidental. could not have been forse...

It's not that simple Joffa - by admitting to blocking a player, is to not admit to causing unreasonable contact. Baker merely entered into Farmer's path - as a defender, to cut his run into a wide open F50 area. In taking this action - Farmer has not seen him ( or maybe he did!!) and cannoned into t...

Well "block" in its ordinary means "to prevent access to". So that's all he is admitting to ... standing in someone's way . If I stand in someone's way on a city street, I haven't bumped, charged or shepherded them or initiated contact. I've simply blocked access. If they got th...

Bakes was told (correctly) to tell the truth. His testimony was corroborated by an independant witness - and that it was emphasised that NOTHING untoward had happened. It was an accidental clash of heads - that could not have possibly been forseen or expected under the circumstances.

Re: A question of reasonableness: basis for appeal

I think the whole appeal comes down to what is reasonable. . Well put Riewoldting. However on this one line...I think the AFL jave set the appeals up now such that you have to put up something "fresh" rather than appealing the determination. If so we need some fresh evidence or a factor t...

[ If The West Australian fails to mention that the Saints submitted photographic evidence in their defence (something that The Age doesn't mention in their report either by the way), how am I going to know that they have? Then don't enter into debates with ppl who have been hanging on every word, o...

[quote="PurpleJesus Where is this "photographic evidence"? Isn't that why the tribunal relied on witness statements, because there was no video or photos of the incident? The St.Kilda F C produced still photos clearly showing where the play was (and the ball) at the precise time of th...

If we get a good QC there is no way the AFL can get away with this. I dont understand this, no evidence, different stories from everyone, yet he gets 7 weeks. Should be the QC's easiest case in a long time. That's what I have been thinking - should've been a soda for a half decent QC. However, if t...

The tribunal accepted Bakes' evidence.

We need to prove the tribunal was wrong, at law, in reaching the conclusion they did.

Actually, Voss initially said he did see it, then when his co-commentator mentioned that he may be called as a tribunal witness he did his best to backtrack. And I have that on video. Yes, Voss is a goose, but that doesn't change what he saw or what he said. Go back to the tape and then get your he...

i'm glad we're appealing. all we need is a witness who saw something different to what the freo bloke saw. You mean like Ricky Nixon? We did have a witness who saw it differently - AND he was an impartial one. We also had the "eye-witness" from Freo make a tosser of himself when he comple...

I believe that a successful appeal can be launched on how the Tribunal reached a guilty verdict on the evidence presented. And that the guilty verdict was based on an action that is allowed for in the rules. So the process could be challenged as flawed and lacking in reason and unjust in it's conclu...

A Tribunal review...

As an advocate who worked in the VCAT Tribunal for over 10 years, allow me to attempt a review of the AFL's tribunal process. VCAT is legislated for and an Act is in place to cover the operations / conduct of all Hearings. The AFL Tribunal will not have this - but will still have it's own rules. The...
