Can someone explain WTF this is all about?
So the Aboriginal flag or whatever its officially called (yellow sun in middle, red bottom, black top) cant be used anywhere anymore as its owned by a clothing brand/company?
Is that the same deal when flying this flag at government buildings, etc?
- Harold Thomas claims he designed the flag that is known as the Aboriginal flag (but there was contention that couldn't be proven because the other person who is said to have designed it is no longer alive)
- In 1995 the Aboriginal Flag was recognised by the Australian Government as an official 'Flag of Australia' under the Flags Act 1953.
- Harold Thomas registered personal ownership of the design.
- The directors of Birubi Art Pty Ltd who were flagged by ACCC for the sale of fake Aboriginal products made in Indonesia were fined over $2million by the Federal government. At least one of directors of Birubi then established a company called WAM clothing and bought a licence from Thomas as the sole owner of the copyright for it's reproduction on clothing, and it has been reported that they have extended that licence since.
- AFL would have to pay royalties to WAM to use the flag on apparel, but it is sketchy whether they can or cannot paint the flag in the centre circle, so have chosen not to.
